PROCEDURE OF INSPECTION AND APPROVAL OF EMPLOYMENT CONTRACT by the Royal Thai Embassy, Helsinki

 

In order to protect Thai citizens who wish to work in Finland in accordance with the Thai Recruitment and Job-seekers Protection Act  B.E. 2528 article 48, following is the procedure concerning inspection and approval for Employment Contract:

  1. The Employer and the Employee send the draft Employment Contract (English version) to the Embassy via Embassy’s email: [email protected]. The Employer is also requested to forward the business license together with the photos of the working place and the accommodation which will be provided by the Employer for the Employee for the Embassy’s consideration. The Embassy shall reserve the right to visit the working place, if deems necessary.

  2. The Embassy will take into consideration the contents of the Employment Contract, namely; wage, welfare, holiday and leave, working time, overtime and holiday payment, termination of contract, in compliance with the local Labour Law. (See draft Employment contract and its appendix below)

  3. The Embassy will inform the Employee or the Employer once the consular officer has completed reviewing the contract. Duration for this proceeding is depended on the priority and the consular officer’s work assignment.

  4. In case the Employer refuses to amend the draft employment contract as being informed by the Embassy and the Employee agrees to sign that contract, the Employee is obliged to write a formal Note to the Embassy notifying that he/ she will take full responsibility for his/her signing and will not claim or request for any assistance from the Embassy demanding for more benefits/ interests which are not stated in the signed contract. (See attachment below)

  5. Once the Employer and the Employee have signed the Employment Contract, the Employer has to submit the signed original contract (together with its English translation, if the original document is not in English) to the Ministry for Foreign Affairs of Finland for legalisation and then submit further the duly legalised documents to the Royal Thai Embassy in Helsinki for legalising the signature of the officer of the Ministry for Foreign Affairs of Finland. 

  6. The Embassy reserves the right to deny approval of any employment contract if there is any indication of labour exploitation in the contents of the contract.

  7. Both the Employee and the Employer are advised to sign or initial their name in each page of the contract in order to avoid any question that may occur concerning the correction of the amount of salary or the period of employment.

Remarks: The employee could not demand for earliest response from the Embassy even though he/she has already received a visa from the Embassy of the Republic of Finland in Bangkok or already reserved their air ticket.
